The Ministry of Justice has reported that the most common method of protecting children's rights to alimony is through the court. There are two methods for resolving this issue - a summary proceeding and a lawsuit to obtain an enforcement document for collecting alimony.
A court order is the fastest way to collect alimony. The case for its issuance is considered by the court based on the submitted documents without calling the parties to the hearing. The court order comes into force on the day of its issuance and has the power of an enforcement document.
“If you want to collect alimony in a larger amount than allowed by the summary proceeding, or if there is a requirement related to establishing or disputing paternity (maternity) and the need to involve other interested parties, you need to file a lawsuit in court.”
If the consideration of the case requires a more detailed analysis or the decision is related to other aspects, it is better to file a lawsuit in court for further resolution of the alimony issue.
