Convicted in the case of sexual violence against a minor
In the case of sexual violence against a minor in Transcarpathia, the court has issued a verdict. Three defendants were sentenced to 6 years in prison. After the verdict, they were taken into custody directly in the courtroom.
The convicts have voluntarily paid 150,000 hryvnias, but they will have to pay an additional 300,000 hryvnias in moral damage compensation.
Duration of the case and the incident
The case lasted 682 days. The incident occurred at the end of August 2021 in the territory of one of the territorial communities of the Mukachevo district.
Cancellation of the decision and new review
In March 2023, the first-instance court sentenced the defendants to 5 years in prison with a probation period of 2 years. However, prosecutors and the victim's lawyers appealed this decision due to the overly lenient punishment. The Transcarpathian appellate court canceled the verdict and sent the case for a new review.
Actions of the authorized representative for human rights
The authorized representative of the Verkhovna Rada of Ukraine for human rights, Dmytro Lubinets, who monitored the case, filed a petition to the Transcarpathian appellate court and appealed to the High Qualification Commission of Judges of Ukraine to avoid delays in the process.
Attempts to delay the case
During the new review, the defense of the defendants attempted to delay the case by illegally mobilizing 18-year-old individuals, removing judges, and changing lawyers. However, the Ministry of Defense responded to the illegal mobilization and refused to draft the defendants.
