Land privatization: what area one person can receive.


Martial law is currently in effect in Ukraine, which restricts land privatization. While there are certain exceptions, the full procedure will be restored after the war.
According to the Land Code, citizens have the right to receive land free of charge for various purposes:
- for farming – in the amount of the land share allocated for members of agricultural enterprises located within the jurisdiction of rural, village, and city councils;
- for personal farming – no more than 2.0 hectares;
- for gardening – no more than 0.12 hectares;
- for the construction and maintenance of residential houses, farm buildings, and structures (in suburban plots) in villages – no more than 0.25 hectares, in towns – no more than 0.15 hectares, in cities – no more than 0.10 hectares;
- for individual summer construction – no more than 0.10 hectares;
- for the construction of individual garages – no more than 0.01 hectares.
The law allows for the transfer of land plots to citizens free of charge, according to the norms provided for each type of use. Thus, a person can privatize six land plots of different intended purposes from this list.
However, according to the Land Code of Ukraine, during the period of martial law in the country or in specific areas, the transfer of state or communal lands into private ownership, the issuance of permits for land development for the purpose of free transfer, or the development of relevant documentation is prohibited.
This provision does not apply to the free transfer of land plots into private ownership for owners of real estate located on these plots, as well as to the free transfer of land plots to citizens of Ukraine that were allocated for use prior to the enactment of the Land Code (since January 1, 2002).
